Please read these terms carefully — they govern your use of NiceList and affect your legal rights.
These Terms of Service ("Terms") are a binding agreement between you and Akers Group, LLC, doing business as NiceList ("NiceList", "we", "us"), governing your access to and use of the NiceList websites, applications, and services (the "Platform"). By creating an account, checking the box indicating acceptance, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
NiceList is a technology platform that helps independent landlords, homeowners, tenants, and service providers (“Pros”) connect, communicate, dispatch and coordinate property-related work, and manage related records.
NiceList is a neutral venue and software tool only. We are not a party to any agreement, transaction, job, lease, or payment between Users. NiceList is not a landlord, property manager, real-estate broker, general contractor, employer, lender, escrow agent, insurer, or party to any service arrangement. We do not perform repairs, manage properties, set prices, supervise work, or guarantee that any User will perform as promised. Any contract for services, tenancy, or payment is solely between the Users involved.
You must be at least 18 years old and able to form a binding contract to use the Platform. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for all activity under your account and for keeping your credentials secure. We may refuse, suspend, or terminate accounts at our discretion.
You are responsible for complying with all laws applicable to your role, including landlord-tenant, fair-housing, licensing, tax, consumer-protection, and safety laws.
Pros are independent third parties, not employees, agents, partners, or representatives of NiceList. We do not employ, supervise, direct, or control Pros or their work. Any badge, “Verified” status, listing, rating, or directory information is provided for convenience and does not constitute an endorsement, guarantee, recommendation, or warranty by NiceList of any Pro's identity, licensing, insurance, qualifications, availability, pricing, or the quality or safety of their work. You are solely responsible for vetting any User you engage, including independently confirming licensing and insurance.
Certain features are offered as paid subscriptions — for example, NiceList Plus for landlords (billed per unit) and NiceList Plus for Pros (billed monthly). The current price and included features for each plan are shown at the point of purchase and on our pricing page. Unless stated otherwise at purchase, subscriptions renew automatically at the end of each billing period at the then-current price, and the payment method on file is charged until you cancel.
You may cancel a subscription at any time from your account settings or by emailing founders@nicelist.ai. Cancellation stops future renewals and takes effect at the end of the current billing period; you retain access to paid features until that period ends.
Except where required by law, subscription fees are billed in advance and are non-refundable, and we do not provide refunds or credits for partial billing periods, unused features, or plan downgrades. If you believe you were charged in error, contact founders@nicelist.ai within 30 days of the charge and we will review it in good faith.
Fees such as the platform transaction fee on Pro payments and any rent-payment processing charge are disclosed before you complete the relevant action and may change with notice.
Payments between Users may be processed by third-party providers (e.g., Stripe), whose terms also apply. NiceList does not hold funds as principal, is not an escrow agent, and is not responsible for the acts or omissions of payment processors, for the authorization, settlement, refund, or reversal of any payment, or for any chargeback, dispute, fee, tax, or non-payment between Users.
You retain ownership of content you submit but grant NiceList a worldwide, non-exclusive, royalty-free license to host, store, display, and use it to operate and improve the Platform. You will not submit unlawful, infringing, fraudulent, harassing, or harmful content; will not misuse the Platform or interfere with its operation; and will not use the Platform to discriminate in violation of fair-housing or other laws.
The Platform and all content, listings, ratings, and directory information are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. NiceList does not warrant that the Platform will be uninterrupted, secure, or error-free, or that any information (including third-party directory data) is accurate, complete, or current.
Property work and in-person services carry inherent risks. You knowingly and voluntarily assume all risks arising from any interaction, communication, property access, repair, inspection, or service arranged or coordinated through the Platform, whether occurring online or in person, and whether involving you, your property, your tenants, your guests, or your invitees.
To the maximum extent permitted by law, NiceList and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, property damage, or personal injury, arising out of or relating to the Platform or any interaction or transaction between Users, under any legal theory, even if advised of the possibility of such damages. NiceList's total aggregate liability for all claims relating to the Platform will not exceed the greater of (a) the total fees you paid to NiceList in the three (3) months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
You agree to defend, indemnify, and hold harmless NiceList and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your content; (c) your violation of these Terms or any law; (d) any dispute, transaction, lease, job, or interaction between you and another User; or (e) any work, service, payment, or property condition involving you.
Because NiceList is only a venue, you release NiceList and its officers, directors, employees, and agents from any claims, demands, and damages of every kind arising out of or connected with any dispute between you and any other User or third party. California residents waive California Civil Code §1542.
Please read this section carefully — it affects your rights. Any dispute arising out of or relating to these Terms or the Platform will be resolved by binding, individual arbitration administered under the rules of a recognized arbitration provider, rather than in court, except that either party may bring an individual claim in small-claims court. You and NiceList waive any right to a jury trial and to participate in a class, collective, or representative action. You may opt out of arbitration by notifying us in writing within 30 days of first accepting these Terms.
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules, except that the arbitration provision is governed by the Federal Arbitration Act. Subject to the arbitration section, the exclusive venue for any permitted court action is the state and federal courts located in Indiana.
You may stop using the Platform at any time. We may suspend or terminate your access at any time, with or without cause or notice. Sections that by their nature should survive termination will survive.
We may modify these Terms by posting an updated version and updating the effective date; material changes may require renewed acceptance. The Platform may link to or integrate third-party services governed by their own terms, for which we are not responsible. If any provision is unenforceable, the rest remains in effect. These Terms are the entire agreement between you and NiceList regarding the Platform.
